1. Agreement to Terms

By accessing or using OdinSight (the "Service"), operated by OakThorn AI ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

OdinSight is a cybercrime intelligence platform that provides:

• AI-powered agents for OSINT investigations
• IP address analysis and threat intelligence
• Username intelligence and digital footprint analysis
• Case management tools for organizing investigations
• Automated report generation and analysis workflows

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Be responsible for maintaining the confidentiality of your account credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Age Requirement

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any applicable laws, regulations, or third-party rights
• Use the Service to harass, abuse, threaten, or intimidate others
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit viruses, malware, or malicious code

5. Credits and Pricing

5.1 Credit System

OdinSight operates on a credit-based system:

• Credits can be purchased at a rate of $1 per credit
• IP analysis and username analysis each cost 1 credit per completed analysis
• Credits are charged only when an analysis completes successfully
• Failed analyses do not consume credits
• Credits do not expire
• Credits are non-refundable except as required by law

5.2 Subscriptions

Case Manager Agent subscription:

• Costs 50 credits per month (equivalent to $50/month)
• Provides access to unlimited case management features
• Auto-renews monthly unless cancelled
• Can be cancelled at any time with access continuing until the end of the billing period

5.3 Payment Processing

All payments are processed securely through Stripe. You agree to provide current, complete, and accurate payment information. We reserve the right to refuse or cancel orders at our discretion.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by OakThorn AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of any data you submit to the Service (IP addresses, usernames, case data, notes). By using the Service, you grant us a license to:

• Process your submitted data to provide the Service
• Store and display your analysis results
• Use aggregated, anonymized data to improve our services

7. Service Availability and Modifications

7.1 Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.

7.2 Service Changes

We may update, change, or discontinue features at any time. We will provide reasonable notice for significant changes that materially affect your use of the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

You are responsible for the lawfulness of any data you submit to the Service. You represent that you have the right to analyze any IP addresses or usernames submitted to our platform.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of analysis results

We do not warrant that the Service will be error-free, secure, or available at all times. Analysis results are provided for informational purposes and should be verified through additional investigation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OakThorn AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar issues transmitted through the Service
• Any errors or omissions in content or analysis results
• Any decisions made based on analysis results

11. Indemnification

You agree to indemnify, defend, and hold harmless OakThorn AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any data you submit to the Service

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of our Acceptable Use Policy
• Fraudulent, illegal, or abusive activity
• Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OakThorn AI regarding the Service and supersede all prior agreements and understandings.
